1. AGREEMENT TO TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Olena Zinchenko ("Company," "we," "us," or "our"), concerning your access to and use of the website https://elenazinchenko.com and the purchase of our digital pilates course ("Services").

By accessing our website or purchasing our course, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you do not agree with these Terms, please do not use our Services.

2. DESCRIPTION OF SERVICES

We offer an online pilates course for women focused on mindful movement, body awareness, and pain-free living. The course is delivered through:

• Video lessons (12 videos, accessible for 3 months from purchase date)
• PDF educational materials (bonus)
• Chat support via Telegram

All course content is for personal, non-commercial use only. The course is intended for general wellness and fitness purposes and is not a substitute for professional medical advice, diagnosis, or treatment.

3. INTELLECTUAL PROPERTY

All content included in or made available through our Services — including but not limited to text, graphics, logos, video content, and PDF materials — is the exclusive property of Olena Zinchenko and is protected by United States copyright laws.

You are granted a limited, non-exclusive, non-transferable license to access and view the course content for personal use only. You may not:

• Share, distribute, or resell course content to third parties
• Copy, reproduce, or republish any course materials
• Share your access credentials or links with others
• Use course content for commercial purposes
• Create derivative works based on our content without written permission

4. PURCHASES AND PAYMENT

Course purchases are processed through Gumroad, a third-party payment processor. By making a purchase, you agree to Gumroad's terms of service and privacy policy.

All prices are listed in US Dollars (USD). We reserve the right to change pricing at any time. The price at the time of your purchase will be honored.

Upon successful payment, you will receive access to course materials via email. Access is granted for 3 months from the date of purchase.

5. REFUND POLICY

We offer a 7-day refund policy from the date of purchase. To request a refund, you must contact us at zinchenkoolena01@gmail.com within 7 days of purchase. Please see our full Refund Policy for details.

6. HEALTH AND FITNESS DISCLAIMER

By using our Services, you acknowledge that:

• You are physically capable of participating in a pilates program
• You have consulted with a healthcare provider if you have any medical conditions
• You assume all risks associated with participating in the exercises
• We are not liable for any injury, illness, or other adverse effects resulting from use of our course

7. PROHIBITED ACTIVITIES

You may not use our Services to:

• Advertise or offer to sell goods and services
• Sell or transfer your account or access to another person
• Violate any applicable laws or regulations
• Engage in any conduct that restricts or inhibits anyone's use of the Services
• Upload or transmit viruses or any other malicious code

Our total liability to you for any claim arising out of or relating to these Terms or our Services shall not exceed the amount you paid for the course ($10 USD).

10. DISCLAIMER OF WARRANTIES

Our Services are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.

11. DISPUTE RESOLUTION

Any disputes arising out of or relating to these Terms or our Services will first be attempted to be resolved through informal negotiations. If informal negotiations fail within 30 days, disputes shall be resolved through binding arbitration in Mecklenburg County, North Carolina, United States.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

If arbitration proceeds to court, litigation shall take place in North Carolina. You have one (1) year from the date the cause of action arose to bring a claim.

12. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions.

13. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. We will notify users of any material changes at least 30 days before they take effect via email to the address provided at purchase. Your continued use of our Services after the effective date of changes constitutes acceptance of the new Terms.
